Terrible service, non-responsive, rude

Not getting some items until 3 weeks after promised delivery date, then having one item back-ordered for another 4-6 weeks, not getting messages returned, getting called stupid by rthe store manager on the telephone... All good reasons never to shop at Furnishings 2 Day ever again.

Furnishings2day scammed me.

MY STATEMENT OF CLAIM AGAINST FURNISHINGS 2DAY (served August 31, 2012):

I purchased a leather sofa from Furnishings2day which was delivered to me on April 10, 2012. This sofa was warranty against defects for 1 year, which I told was the store's standard warranty for all sofas.

The sofa which was delivered to me was distinctly different in quality and features than the one displayed in the showroom. What I noticed immediately was that the decorative stitch pattern and tufts present in the showroom display model was missing from my sofa. I complained immediately (right at the time of delivery) about this and the storeowner promised to phone me back. The storeowner did not reply, so I attended the store (the same day) and demanded that the sofa be returned for a full refund, however, the storeowner agreed to refund me $500.00 (of the $2050.00 purchase price) for the missing decorative stitching and missing tufts.

This refund was ONLY for the missing decoration and tuft stitching and not for the other significant deficiencies I later discovered.

Note that up until this point I had not actually inspected the sofa nor sat on it, because, until I received the refund, I had no intention of keeping the sofa (because it was not the same sofa displayed in the showroom).

After receiving the $500.00 refund, I returned home and inspected the sofa closely. I noticed more differences in my sofa compared to the one displayed in the showroom. I noticed that the leather quality of my sofa was distinctly different in texture and appearance. The display room sofa was smooth and soft, and tight around the corners, whereas my leather was "grainy" and wrinkly at the edges and corners, and had a stiff plastic feel to it. Furthermore, there is a hollow spot in the seating area which sinks deep and is missing cushioning. This hollow spot has caused the leather to stretch and become loose.

After a few days, I noticed that paint was coming off the seating area and I immediately phoned the storeowner about this. The storeowner reiterated that the sofa was warranty against defects for 1 year and promised to "look after" the paint problem.

I was shocked to see the paint come off because the sales staff reassured me that the leather was high quality "genuine leather". In fact, the sales staff even told me that their "genuine leather" is what distinguishes their store from other furniture stores which sell a low quality "bonded leather".

The paint continued to come off increasingly, particularly where the leather bends and stretches the most. For instance, the problem is most severe at crease lines and on the vertical sides of the seated area, where the leather bends and is stretched the most. The paint problem does not appear to be caused by friction, and the paint does not "rub off". Instead, the paint appears to loose its adhesion where the leather is stretched the most, such as the vertical sides which bends when the sofa is sat on.

About three weeks after delivery of my sofa, the storeowner came to inspect the faulty sofa and immediately accused me of applying a "chemical cleaner" to the sofa.

I insisted that I NEVER used ANY cleaner on the sofa, NOR did I ever clean the sofa (it was brand new), NOR do I possess any chemical cleaner. Furthermore, I cannot imagine ANY household cleaner, even bleach, which would cause so much paint damage in such a short time. However, he continued accusing me of using a "chemical cleaner" and used this as your excuse for not accepting responsibility for the faulty paint.

My wife and I have no children (meaning no jumping on the sofa), we are strict about no eating or drinking in the living room (so there's no reason to clean the sofa), and we only use the sofa about 20 minutes each day. (Even jumping kids would not cause this much paint removal anyways.)

I also own two other leather sofas purchased 13 years ago, and own other leather furnishings, none of which are from Furnishings2day, and none of them have the slightest mark on them, so my usage habits are certainly not the cause of the paint problem.

Its now over 4 months since I received the sofa. Almost all the paint has come off some sections of the sofa, and the hollow spot is now so deep that I can feel the support beams under the cushion.

The storeowner refuses to return my phone calls now.

Furthermore, I posted an online complaint about my experience, including photos, and within a few days, I was contacted by another shopper who complained that he purchased the exact same sofa as mine. He also discovered that the sofa delivered to him was completely different than the sofa displayed in the showroom. Furthermore, he told me that he sued Furnishings2day in small claims court and asked for my statement as similar-fact evidence on his trial on June 25, 2012, which I provided to him. He phoned me immediately after the trial to advise me that his claim was successful and he received a full refund.

It is apparent that the high quality displays in Furnishings2day's showroom is not what is delivered to customers. Although the sofa I received was similar in size and appearance to the one displayed in the showroom, it is obviously different in quality and features. The paint on my sofa came off almost immediately when I sat on it. There is hollow spot in the cushion which sinks right down to the beams underneath. The decorative stitching and tufts are absent in my sofa. This is definitely not the same sofa displayed in the showroom. Furnishings2day fraudulently misrepresented the sofa by displaying a high quality, durable, sofa in their showroom, but then delivered a sofa which is severely inferior in quality and features.

My sofa is now worthless, and is nothing more than "junk". No one will accept my sofa even as a free donation.

The only remedy is for the sofa to refund it fully, less the $500.00 refund provided previously.

On July 27, 2012, I sent a demand letter to Funishingsday by registered mail. The letter demanded a full refund and retrieval of the sofa by Furishings2day. This letter was later returned to me by Canada Post because it was not accepted by the store. (The previous plaintiff told me this was precisely what he experienced when he also sent a demand letter.)
